Full Terms and Conditions

 

1. Confirmation of Acceptance: By submitting your entry to this Promotion, you confirm that you have read and understood these Terms and Conditions and agree to be bound by them. Please retain a copy for your information.

2. Eligibility: This Promotion is only open to residents of the United Kingdom and Republic of Ireland who are aged 18 or over (“you”, “your”, “entrant”). Any employees or workers of the Promoter (or any of its group undertakings and its agencies who are directly connected with the creation and administration of this Promotion) are excluded from entering this Promotion. This Promotion is also not open to employees (or family members of employees) of any Sky UK Limited (“Sky”) companies associated with the Promotion and all affiliates of such companies

3. Purchase Requirements: Purchase is necessary for UK residents only (see clause 7 for a list of Participating Products). Please retain an itemised receipt that states the time and date of purchase prior to entry, but within the Promotion Period, as this may will be required for validation and in order for the winner to receive the Prize. No purchase required for ROI residents. Internet access and smart is required.

4. Please note that while we want to encourage you to participate and enjoy the benefits of the Promotion we believe in responsible consumption of our products. DO NOT purchase more product than you can reasonably use or consume just to participate in this Promotion.

5. Promotion Period: Enter between 00:01 BST on the 16 July 2023 and 23:59 BST on the 09 October 2023 inclusive. Any entries received before or after the Promotion Period will not be valid and will not be entered into this Promotion.

6. To Enter:

You will be directed to a site and will be required to complete the online form your full name, email address, phone number, postcode and the last 4 digits of the barcode found on the product to find out instantly if you have won a Prize.
ii. ROI: Visit win.cadbury.co.uk/poundland-sky-2023, complete the online form providing your details (full name, email address, phone number & postcode) to find out instantly if you have won a Prize.
b. Prize Draw: All valid entries from the UK & ROI will be entered into the Grand Prize Draw.

8. Maximum 1 entry per person. Maximum 1 prize per person. Entries over the maximum number of entries will be void. One itemised receipt per entry must state the time and date of purchase, which must pre-date the entry date and time, but be within the Promotion Period.

9. The Prizes:
a. Instant Win:
i. There will be a total of 201 prizes to be won. Each winner will win 1 x Sky Store Vouchers worth £5.49 (€5.99 for ROI upon request)
b. Prize Draw:
i. There will be 5 winners. Each winner will win 1 x Sky Q package. The Sky Q package consists of:
a. 1 x Sky Q TV subscription for 12 months to include the following:
b. 1 x Sky Q Complete Bundle TV package including Sky Sports Complete and Sky Cinema;
c. 1 x Sky Q Multiscreen subscription; and
d. Free standard installation provided by Sky subject to the Prize Conditions
e. Sky will also loan the prize winner 1 x Sky Q 2TB box and 1 x Sky Q Mini box at no charge

10. Further Prize Details and Conditions:
a. The Promoter will not be responsible for telecommunication failure on the part of the Entrant’s service provider.
b. Instant Win: Sky Store Voucher Terms and Conditions:
i. The Sky Store £5.49 (€5.99 for ROI upon request). Voucher may be redeemed at Sky Store to credit your account with £5.49 (€5.99 for ROI upon request). Sky Store Vouchers may only be redeemed and spent on either the Sky Store website located at www.skystore.com, or on the Sky Store app on your compatible Roku box. The Sky Store £5.49 Voucher ((€5.99 for ROI upon request). cannot be used for purchases made on a Sky+HD box or a Sky Q box. However, Buy & Keep purchases made using redeemed Vouchers can be sent to your box. Send to Sky Box’ is not available on rental titles.
ii. To redeem a Voucher, you must have a SkyiD account and have accepted Sky Store terms and conditions. These terms apply in addition to Sky Store terms and conditions and in the event of any conflict, these terms prevail.
iii. The Sky Store £5.49 Voucher ((€5.99 for ROI upon request). is valid until 31st March 2024. Once expired, the Voucher will be invalid and cannot be extended, replaced, or refunded. It is not replaceable if lost or stolen and no refund will be given.
iv. To redeem online:
1. Simply go to www.skystore.com/redeem
2. Enter your Voucher code and click ‘Redeem’
3. Sign up or sign in (you don’t have to be a Sky TV customer)
4. Choose your movie and watch online, on your favourite devices or select DVD or Blu-ray to receive a copy in the post too.
5. When redeemed, the Voucher will credit your account with a value in the local currency and all purchases will be made using your available balance. When you make a purchase, the cost will be deducted from the value held in your account and if there is any difference between the cost of the purchase and the value in your account, you will need to pay this amount.
v. Once added to your account, you will have 12 months in which to use your credit balance before the balance is removed from your account. Any unused balances are not redeemable for cash or transferable and will not be returned to you (unless we are required to by law).
vi. Each Sky Store £5.49 Voucher ((€5.99 for ROI upon request). is considered to have been redeemed once successfully applied to the account on Sky Store. Each Voucher may only be used once, repeated attempts to use the same Voucher will not be successful. You cannot re-load or top-up Vouchers.
vii. The Sky Store £5.49 Voucher(€5.99 for ROI upon request). is for your own personal, non-commercial use. There is no cash alternative; Sky Store £5.49 Voucher ((€5.99 for ROI upon request). is not transferable and may not be re-sold.
viii. The Sky Store £5.49 Voucher ((€5.99 for ROI upon request). remains the property of Sky UK Limited.
ix. Sky is not responsible for any Vouchers that are lost, stolen, destroyed or used without your permission.
x. Sky Store’s general terms and conditions apply; https://www.skystore.com/n/lbtc/legal-bits/terms-and-conditions. Sky UK Limited reserves the right to amend these terms and conditions at any time and without notice. These terms and conditions and any related disputes are subject to interpretation under the laws of England and Wales, and to the jurisdiction of the courts of England and Wales unless your residential address is in Scotland, when Scottish law applies or in the Republic of Ireland, when Irish law applies.
c. Prize Draw: Sky Q Packages Terms and Conditions
i. The Prize will be arranged between Sky and the winner directly. The winner’s details will be collected by the Promoter and sent to Sky, who will contact the winner and fulfil the prize directly with the winner.
ii. The winner will be required to enter into a new Sky Q TV subscription contract. If the winner is an existing Sky TV customer, your existing Sky TV subscriptions will come to an end and you must enter into a new Sky Q TV subscription contract.
iii. After your 12 month free Sky Q TV subscription comes to an end, standard subscription length (18 months) and prices at the time of re-contracting will apply, unless you change or cancel your package, giving Sky at least 31 days’ notice. Standard subscription prices may change. Please refer to www.sky.com for current pricing. You must be over 18 and resident in the United Kingdom.
iv. The Prize does not include:
1. A broadband subscription (to experience Sky Q features to the full, we recommend connecting your boxes to home broadband);
2. Sky Box Office, Sky Store purchases/rentals, Stand-alone Premium Channels, or pay-per-view services and events
v. Watching on an extra TV screen comes at a one-off cost of £99 and Sky will loan you an extra Sky Q Mini at no cost (recommend connecting no more than 4 Sky Q Minis in total)
vi. Prices, programmes/channels are subject to change.
vii. Engineer set-up required.
viii. The winner must get any consents required (e.g. landlord’s) prior to installation.
ix. Winners must redeem the prize within a year. Winners who are in a current pay-TV contract with another provider may defer their Prize for a maximum of 12 months from the date of winning. If a winner does not redeem his/her Prize within 12 months from the date of winning, this could result in loss of the Prize. If the winner has a previous uncleared debt with Sky the winner will not be able to take up the Prize until this debt has been fully cleared.
x. There is no cash alternative to the Prize or any element thereof and unless agreed otherwise in writing the Prize is non-refundable and non-transferable.
xi. Sky reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that Sky reasonably regards as inappropriate, offensive or unlawful.
xii. Prize winner will own the Sky dish. The Sky Q box, the Sky Q Mini and all other Sky Q kit is loaned to the winner at no cost and must be returned when the winner’s 12 month prize subscription terminates or when the winner leaves Sky, whichever is earlier. Mechanical faults with the Sky Q kit will be repaired at no cost.
xiii. Sky Q installations currently average a 28 day waiting period.

11. Winner Selection:
a. Instant Win: During the Promotion Period 201 “winning moments” (days, hours, minutes, seconds) have been randomly selected by an independent verification service. The first valid entry on or after each winning moment will be awarded the prize. If no entry is received between one winning moment to the next, the prize from that winning moment will be rolled over, creating an additional winning moment. All instant win prizes are available to be won.
b. Prize Draw: 1 provisional winner will be randomly selected from all valid entries received during the Promotion Period. For your total confidence, the prize draw will be conducted by PromoVeritas, an independent promotional verification service, within 5 working days of the end of the Promotion Period.

12. Winner Notification:
a. Instant Win: The winning entrants will be instantly notified on screen that they are a provisional winner. They will also receive a confirmation email to their email address used upon entry, confirming their Prize and will be required to follow the instructions, confirming eligibility and acceptance of the prize. In the event that a winner does not provide the required details within 14 days, the Promoter reserves the right to disqualify that winner and return the Prize to the Promotion Prize pool which may be won by another entrant during the Promotion Period.
b. Prize Draw: The provisional winner will be contacted via the email address provided on entry immediately after Winner Selection and will be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the provisional winner. Once eligibility has been confirmed, the provisional winner will be confirmed as a winner. If the provisional winner does not respond to the initial contact within 3 days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.

13. Prize Acceptance: Once eligibility of a Prize is confirmed and the Prize is accepted, fulfilment of Prizes will take place within 28 days of acceptance of the Prizes. In the unlikely event that the Prize does not arrive within this number of days, within 28 days the Winner must inform the Promoter by emailing [email protected]. If a winner does not do so, the Promoter reserves the right to not reissue the Prize or limit its value at its sole discretion.

14. Provided no objection is received, the surname and county of the winners will be made available to anyone who requests them by writing to JS13856 Cadbury Sky, PO Box 704, Pinner, HA5 9PF within 3 months of the closing date. In the event they win, winners may request their surname and county are not published or request for the amount of information being published to be reduced during Winner Notification. Without prejudice, the Promoter will provide this information to the Advertising Standards Authority on its reasonable request.

15. It is the responsibility of the Entrant to provide their correct, up-to-date details when entering the Promotion and/or confirming acceptance of the Prize in order for the Prize to be processed. The Promoter cannot be held responsible for winners failing to supply accurate information which affects Prize Acceptance or delivery of their Prize.

16. The Promoter fully respects freedom of speech, but prior to entering the promotion, the winner must not have and warrants that they have not posted, published or caused to be published by way of press, radio, television or in any social medium, any comments that are likely to discredit or damage the reputation of the Promoter or their product(s) or service(s) or be in breach of the rules of the relevant media. In addition, the winner must not do so during the life of the Promotion or Prize. If, the Promoter, in its absolute discretion, decides that the winner has breached this condition, it may disqualify the Entrant and the winner’s entitlement to the Prize may be cancelled and a substitute winner chosen on the same basis as the original winner.

17. The Promoter may request that the winners participate in publicity arising from the Promotion. The winners are under no obligation to participate and may decline this request. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.

18. The Prizes are not transferable or exchangeable and cannot be redeemed for any other form of compensation. The Prizes and the Promotion have no cash value. If for any reason any element of a Prize is not available, the Promoter reserves the right, at its sole discretion, to substitute another prize for it, with equivalent value.

19. For the avoidance of doubt, it is the responsibility of the Entrant to ensure they are in receipt of promotional communication relating to the Promotion (including checking their junk/spam). The Promoter is not responsible for an entrant making a late claim on their win if the notification from the Promoter is missed for any reason.

20. The Promoter reserves the right to verify the eligibility of any and all Entrants The Promoter may require the Entrant to provide such information as it considers reasonably necessary to verify the eligibility of the Entrant and the Promoter may, in its sole discretion, disqualify or withhold any prize from any Entrant who fails to satisfy the eligibility requirements or satisfy the Promoter as to such eligibility. If for any reason any aspect of this promotion is not capable of running as planned, including (but not limited to) by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, malware incident, technical failures, pandemic, epidemic, Government order or guidelines, delay in delivery of Promotional packs (including to the Promoter by its own suppliers), or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries.

21. The Promoter’s decision on any aspect of the Promotion is final and binding and no correspondence will be entered into about it.

22. The winner is responsible for any costs or expenses involved in claiming or using the Prize other than those that are expressly stated above as being included as part of the Prize.

23. No responsibility is taken by the Promoter for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete, or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to the promotional text line, website, or other online platform (as applicable).

24. The Promoter, together with any associated agencies and companies, will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion, or in connection with accepting or using a Prize, except for any liability which cannot be excluded by law. Nothing will exclude the Promoter’s liability for death or personal injury as a result of its negligence.

25. The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entries (and any of your associated aliases) will be disqualified, any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
a. Verify the eligibility of entrants and/or provisional winners by requesting such information it consider reasonably necessary for this purpose. Entry or a Prize may be withheld unless and until verification is completed satisfactorily.
b. Disqualify entries that are not made directly by the individual entering the Promotion.
c. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator; or entries made using multiple social media handles.
d. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
e. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, multiple SIM cards for Text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
f. Disqualify entrants who tamper with the entry process.
g. Disqualify entries which, in some other way, do not fully meet the requirements of these Terms & Conditions.
h. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.

26. The Promoter will not be liable for any failure to comply with its obligations or any delay in performing its obligations within these terms and conditions If an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God, or any other circumstances beyond the reasonable control of the Promoter.

27. The Promoter may refuse to award a Prize and may void any entry in the event of any Entrant’s (or the Promoter reasonably suspecting any Entrant’s) fraud, dishonesty, breach or non-entitlement under these Terms & Conditions or seek recovery of the value of the Prize if the Prize has been awarded.

28. The Promoter shall comply with all applicable requirements of the Data Protection Act 2018, the General Data Protection Regulation 2016 and any successor legislation or other applicable law. The personal information entrants provide will be used by the Promoter for the purpose of conducting this promotion and in accordance with the Promoters’ Data Privacy Notice which can be found at https://www.mondelezinternational.com/Privacy-Policy.

29. Any and all personal data provided by the Prize Draw Winner will be supplied directly to Sky and used solely to assist with fulfilling the Prize Draw Prize. Sky will not contact you for reasons other than this Promotion unless you have provided your express consent. All personal data will be handled in accordance with Sky’s privacy policy, available at: www.sky.com/help/articles/sky-privacy-and-cookies-notice

30. The Promoter may disclose Entrants’ personal information to its contractors and agents to assist in conducting this Promotion (including any relevant promotional activity) or communicating with Entrants.

31. If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions.

32. The Promoter does not assume any responsibility for any typographical or other error in the administration of the Promotion. Additionally, the Promoter is not liable for the reproduction of this offer or indirect access via third party websites of these Terms and Conditions and where such reproduction misstates or omits an of the information or terms and conditions connected with this Promotion.

33. The Promoter is not liable for any damage or loss to a Prize caused by any third party. If a Prize is damaged or fails to be delivered, the Promoter has no obligation to provide a replacement prize.

34. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

35. The Promotion, together with these Terms & Conditions, and any non-contractual obligations arising out of them are governed by the laws of England and Wales and their interpretation and application will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
