Full Terms & Conditions:
- This Promotion is open to residents of Great Britain, excluding the Channel Islands and the Isle of Man, aged 18 or over, excluding employees of the Promoter, its agents and anyone professionally associated with this Promotion.
- No purchase necessary; however, internet access, a valid email address and mobile number are required to enter. A smart device with a camera is required to redeem the First Bus voucher.
- Promotion Period: Enter between 12:00 BST on the 17 July 2024 and 16:00 BST on the 25 July 2024 inclusive.
- To Enter: Visit win.cadbury.co.uk/flake99bus and complete the online form with your details (name, email address and mobile number) and your preferred departure and return location choice of either London or Leeds/Bradford to be entered into the relevant Prize Draw.
- Maximum of 1 entry is permitted per person during the Promotion Period. No person may win more than 1 Prize.
- The Prizes:
- London: There will be a minimum total of 42 winners. Dates allocated randomly. Each winner will win 4 x same day return seats on the Cadbury Flake 99 Bus from London to Southend, Essex for the winner and up to 3 guests, plus 1 x free ice cream per person from the Cadbury Flake 99 Ice Cream Van. Each winner will also win a voucher for 2 x single adult tickets with First Bus (worth £4 total).
- 21 winners can each bring up to 3 guests for the Bus on Saturday 10 August 2024; and
- 21 winners can each bring up to 3 guests for the Bus on Sunday 11 August 2024.
- Leeds/Bradford: There will be a minimum total of 43 winners. Dates allocated randomly. Each winner will win 4 x same day return seats on the Cadbury Flake 99 Bus from Leeds or Bradford to Bridlington, East Yorkshire for the winner and up to 3 guests, plus 1 x free ice cream per person from the Cadbury Flake 99 Ice Cream Van. Each winner will also win a voucher for 2 x single adult tickets with First Bus (worth £4 total).
- 21 winners can each bring up to 3 guests for the Bus from Leeds on Saturday 17 August 2024; and
- 22 winners can each bring up to 3 guests for the Bus from Bradford on Sunday 18 August 2024.
- London: There will be a minimum total of 42 winners. Dates allocated randomly. Each winner will win 4 x same day return seats on the Cadbury Flake 99 Bus from London to Southend, Essex for the winner and up to 3 guests, plus 1 x free ice cream per person from the Cadbury Flake 99 Ice Cream Van. Each winner will also win a voucher for 2 x single adult tickets with First Bus (worth £4 total).
- Further Prize Details and Conditions:
- Winners must respond on the claim page by 23:59 on Sunday 28 July 2024 confirming their attendance and how many guests they will be bringing (up to a maximum of 3). Once they have inputted the number of guests, this cannot be amended.
- If the winner has chosen fewer than 3 guests, the Promoter reserves the right to recall the spare ticket(s) and award them to a reserve.
- Any minors must be accompanied by a responsible adult with their parent/legal guardian’s written consent.
- Each passenger is permitted 1 x standard rucksack size bag. Buggies may be placed underneath the Bus in the luggage area. On the claim page, please inform the Promoter of your intention to bring a buggy. There will be limited storage space and places will be allocated on a first come first served basis from notifying the Promoter on the claim page.
- Winners should inform the Promoter of any wheelchair or access needs for themselves or their guest(s) on the claim page.
- Bus and coach companies are not required by law to provide child car seats and they will not be provided on the Bus. Children can travel unrestrained, and it will be at the parent’s discretion whether they would like to bring a suitable car seat, though it cannot be guaranteed that it will fit the coach.
- London:
- Winners must meet at the agreed meeting point at Minories, Tower Hill in London on their allocated day to board the Bus. The exact meeting point and time will be communicated to the winners during winner communications.
- The Bus is expected to depart from London at approximately 10:00 and from Southend at approximately16:00. All passengers should arrive at least 15 minutes before the stated departure time.
- Leeds:
- Winners must meet at the agreed meeting point in Leeds on their allocated day to board the Bus. The exact meeting point and time will be communicated to the winners during winner communications.
- The Bus is expected to depart from Leeds at approximately 10:00 and from Bridlington at approximately 16:00. All passengers should arrive at least 15 minutes before the stated departure time.
- Bradford:
- Winners must meet at the agreed meeting point in Bradford on their allocated day to board the Bus. The exact meeting point and time will be communicated to the winners during winner communications.
- The Bus is expected to depart from Bradford at approximately 10:00 and from Bridlington at approximately 16:00. All passengers should arrive at least 15 minutes before the stated departure time.
- There will be a 20-minute grace period for late departures, on both the outbound and inbound journeys. If the latecomer(s) do not arrive, the Bus will depart.
- The Promoter accepts no responsibility for any passengers arriving late and the consequences this may have on missing the trip.
- The departure times are subject to change based upon factors such as weather and traffic conditions. These will be communicated to winners at the earliest opportunity.
- If, for any reason, a winner is no longer able to attend, they should inform the Promoter as soon as possible. The Promoter reserves the right to recall the Prize and award it to a reserve.
- At all times, the Promoter will have the discretion as to how to implement the Prize fulfilment.
- The winners will be allocated a date which cannot be changed.
- All elements of the Prize must be taken as part of the same Prize package.
- Winners and their guest(s) must travel together in both directions.
- The winner is responsible for the behaviour of themselves and their guest(s) whilst taking the Prize. The Promoter reserves the right in its absolute discretion to exclude a winner and/or their guest(s) from participation in any aspect of the Prize if any party fails to comply with the directions of the Promoter or any companies associated with the Prize or if the winner and/or their guest(s) act in a manner that is dangerous to themselves or to the public or is, in the opinion of the Promoter, anti-social in any manner or which causes a disturbance or nuisance to others. Failure to comply with these Terms and Conditions may result in refused transport or entry, or the ticket holders being required to leave the Bus/trip.
- The winner and their guest(s) must abide by any relevant terms and conditions which form part of the Prize. Whilst on the Bus/trip, they must not: be drunk, intoxicated, under the influence of drugs, underage, be abusive, threatening, make or incite racial abuse, chant, use offensive language, make obscene gestures, throw items, behave anti-socially, carry laser pens, bring animals (except guide dogs), carry offensive weapons or illegal substances, carry candles, climb any structure, make excessive noise, offer any item for sale, damage the venue or smoke. Failure to comply with these Terms and Conditions may result in refused entry, or the ticket holders being required to leave the Bus/trip.
- Alcohol consumption is strictly prohibited on the Bus.
- For the avoidance of doubt, the Prize does not include any accommodation, food, beverages, souvenirs, gratuities, car parking charges, or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither the Promoter nor any provider of any part of the Prize will be responsible for any such costs.
- Please be aware of the safety guidelines of the relevant beaches, available at bridlington.net/bridlington-tourism-information/tourism/bridlington-beach-safety/ and southend.gov.uk/beaches/beach-safety.
- The Promoter may request winners participate in promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge. If winners would like to participate, they must provide consent for the Promoter to use their name and images in promotional material.
- By consenting to participate in publicity, the winner grants the Promoter the absolute and irrevocable right and permission to use, publish, publicly display, perform, transmit, exhibit and reproduce their name, statements, video, voice, recordings, interviews, photographs or other visual or audible representations or likeness, in whole or in part, individually or in conjunction with other material, including without limitation, text, photographs or images in any medium (whether now known or hereafter invented) including, but not limited to the internet and other electronic and social media and for any and all purposes, publicity, promotion, packaging and trade throughout the world without restriction as to manner, frequency or duration of use or any other purpose whatsoever in connection with this promotion or in connection with the marketing of the products of the Promoter, or otherwise. The winner further agrees that all materials produced pursuant to the rights set out above shall and will remain the property of the Promoter.
- First Bus voucher:
- The winners will be provided with a QR code on the Bus, which they should scan to redeem their voucher and download the First Bus app. Winners must sign into their First Bus account (or create one for free) and add their voucher code at checkout to receive their tickets.
- The voucher will cover two single journeys worth £2 each. The voucher can be used for two single journeys or one return journey. It can be used for adult or child tickets.
- If the journey cost is less than £2 each way, the winner will not receive any compensation for the difference.
- The voucher is valid for 3 months.
- The voucher is valid within the First Bus network only.
- Winner Selection: 42 provisional winners will be randomly selected from all valid entries into the London Prize Pool received during the Promotion Period and 43 provisional winners will be randomly selected from all valid entries into the Leeds/Bradford Prize Pool received during the Promotion Period (both “provisional winners”). For your total confidence, the Prize Draws will be conducted by PromoVeritas, the independent promotional verification service, within 1 working day of the end of the Promotion Period.
- Winner Notification: Provisional winners will be contacted via the email address and/or mobile number provided on entry within 1 working day of Winner Selection and will be asked to access a claim page where they will provide evidence of identity and eligibility alongside confirming their attendance, the number of guests they would like to take and any wheelchair or access needs of themselves and/or their guest(s). Reasonable efforts will be made to contact the provisional winners. Once eligibility has been confirmed, the provisional winner will be confirmed as a winner. If a provisional winner does not input their response onto the claim page by 23:59 BST on the 28 July 2024, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.
- Prize Acceptance: Notification to arrange fulfilment of the Prize will take place within 5 days of acceptance of the Prizes. In the unlikely event that a winner has not received communication to arrange their Prize, the winner must inform the Promoter by emailing [email protected]. If a winner does not do so, the Promoter reserves the right to not reissue the Prize at its sole discretion.
- Provided no objection is received, the surname and county of the winners will be made available to anyone who requests them by writing to JS14775 Cadbury Flake 99 Bus to the Coast, PO Box 704, Pinner, HA5 9PF, within 3 months of the closing date. In the event they win, winners may request their surname and county are not published or request for the amount of information being published to be reduced during Winner Notification process. Without prejudice, the Promoter will provide this information to the Advertising Standards Authority on its request.
- The Promoter may request that the winners participate in publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.
- The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
- Verify the eligibility of entrants and/or provisional winners through multiple means by requesting such information it consider reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
- Disqualify entries that are not made directly by the individual entering the Promotion.
- Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
- Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
- Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
- Disqualify entrants who tamper with the entry process.
- Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.
- Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.
- The Prizes are not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason the Prize and/or any element of the Prize is not available, the Promoter reserves the right, at its sole discretion to substitute that Prize or element of the Prize for another of equal or greater value.
- No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to win.cadbury.co.uk/flake99bus.
- This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. By entering you are providing your information to the Promoter and not to Facebook or Instagram, and Facebook and Instagram are not responsible for any element of this Promotion.
- The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS14775) or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.
- The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.
- The Promoter shall comply with all applicable requirements of the Data Protection Act 2018, the General Data Protection Regulation 2016 and any successor legislation or other applicable law. The personal information entrants provide will be used by the Promoter for the purpose of conducting this promotion and in accordance with the Promoters’ Data Privacy Notice which can be found at https://privacy.mondelezinternational.com/eu/en-gb/privacy-notice/. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Promotion (including any relevant promotional activity) or communicating with entrants.
- If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.
- By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.
- If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
- These Terms & Conditions are governed by English law and their interpretation and application will be subject to the non-exclusive jurisdiction of the courts of England and Wales. Residents of Scotland may bring proceedings in their own jurisdiction.
